Privacy Policy

Last updated: 18 August 2026

Colourberry (“Colourberry”, “we”, “us” or “our”) respects your privacy and is committed to protecting the personal information we hold about you. This Privacy Policy explains what information we collect, why we collect it, how we use and store it, who we share it with, and the choices and rights available to you.

Colourberry is a film production, 3D animation, web design, SEO and photography studio operating from 4 Hasking Street, Caboolture QLD 4510, Australia. We help organisations transform complex technical ideas into compelling visual stories.

This policy is written to comply with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). Because we also work with clients and website visitors located in the United Kingdom and the European Economic Area, it additionally sets out how we comply with the UK GDPR and the EU General Data Protection Regulation (GDPR) where those laws apply to our handling of your information.

By using colourberry.com, contacting us, or engaging us for a project, you accept the practices described in this policy. If you do not agree with it, please do not use the site or submit information to us.

The information we collect

Information you provide to us directly

Most of the personal information we hold is information you have chosen to give us. This typically includes:

  • Enquiry and contact details, such as your first name, last name, email address, telephone number, the subject of your message and anything else you write in the message body when you use our contact form, email us at Simon@colourberry.com, call or message us on +61 409 400 315, or reach us via WhatsApp or LinkedIn.
  • Newsletter and marketing sign-up details, such as your name and email address when you join our mailing list.
  • Client and project information, such as your business name, role, billing address, ABN, purchase order references, brief documents, scripts, brand assets, site access details and any other material you supply so we can deliver a project.
  • Payment and billing information, such as bank transfer references and invoice records. We do not store full credit card numbers on our systems.
  • Correspondence, including emails, messages, meeting notes, call notes and feedback exchanged during a project.

You are not obliged to identify yourself when you make a general enquiry. However, if you choose to deal with us anonymously or under a pseudonym, we may not be able to quote accurately, deliver a project or respond usefully to your request.

Information collected through filming, photography and production work

Because of the nature of our work, we routinely capture images, video footage, audio recordings and voice recordings of identifiable individuals. This includes corporate video shoots, safety and induction filming, testimonial interviews, headshots, group photography, product demonstrations and on-site documentation.

Photographs, video and audio of an identifiable person are personal information under Australian law and personal data under the GDPR. We treat this material with the same care as any other personal information we hold. In practice this means:

  • We collect this material on behalf of, and at the direction of, the client who has engaged us for the shoot. That client is generally responsible for obtaining consent, model releases and any workplace notifications required before filming begins.
  • Where we are asked to obtain releases ourselves, we will explain how the footage is intended to be used before recording.
  • We store raw footage, project files and finished assets securely, and we use them only for the purposes of delivering the project, unless the client and the individuals concerned have agreed we may also use excerpts in our portfolio or showreel.
  • If you appear in material we have captured and you have questions about how it is being used, contact us and we will help you, or put you in touch with the client who commissioned the work.

Information we collect automatically

When you visit colourberry.com, some information is collected automatically by our website and the services that support it. This can include your IP address, approximate location derived from that IP address, browser type and version, device type and operating system, screen resolution, referring website, the pages you view, the time and duration of your visit, and the links you click.

This information is collected through cookies, tags and similar technologies, and through standard server logs kept by our web host. In most cases it is used in aggregate and does not identify you personally, although in some circumstances an IP address may be treated as personal information.

How we use your information

We use the personal information we collect for the following purposes:

  • To respond to your enquiry, prepare quotes and proposals, and answer questions about our services.
  • To plan, produce and deliver film, animation, web design, SEO and photography projects.
  • To manage our client relationships, including scheduling, project updates, revisions and approvals.
  • To issue invoices, take payment and keep the financial and tax records we are required by law to keep.
  • To send our newsletter, project updates, case studies and occasional marketing communications where you have subscribed or where we have an existing business relationship with you.
  • To operate, secure, maintain and improve our website, including understanding which pages are useful and where visitors encounter problems.
  • To showcase completed work in our portfolio, showreel, blog and social media, where the relevant permissions are in place.
  • To comply with our legal obligations, resolve disputes and enforce our agreements.

We will not use your personal information for a purpose that is unrelated to the one for which it was collected unless you would reasonably expect it, you have consented, or the law permits or requires it.

Our legal bases for processing (UK and EEA visitors)

Where the UK GDPR or EU GDPR applies to our handling of your personal data, we rely on the following legal bases:

  • Contract: where processing is necessary to enter into or perform a contract with you, for example delivering a commissioned production or responding to a request for a quote.
  • Legitimate interests: where processing is necessary for our legitimate interests in running, promoting and securing our business, provided those interests are not overridden by your rights. This covers activities such as website analytics, business development correspondence with existing contacts, portfolio use of completed work, and fraud prevention.
  • Consent: where you have given clear consent, for example to receive marketing emails, to the placing of non-essential cookies, or to appear in footage that will be used publicly. You can withdraw consent at any time without affecting the lawfulness of processing carried out before withdrawal.
  • Legal obligation: where we must process information to comply with Australian tax, corporate or other legal requirements.

Cookies and website analytics

Our website uses cookies, which are small text files placed on your device. Some are strictly necessary to make the site work, remember your preferences and keep it secure. Others are analytics or performance cookies that help us understand how the site is used.

We use Google Analytics and Google Search Console, accessed through the Google Site Kit plugin, to measure traffic and understand how visitors find and use our pages. Google may set cookies and process data on our behalf. You can find details of how Google handles this information in Google’s own privacy policy, and you can opt out of Google Analytics using Google’s browser add-on.

You can control or delete cookies through your browser settings at any time. Blocking all cookies may affect how parts of the site function. Some pages may also embed content from third parties such as video players or social media platforms, and those providers may set their own cookies when the content loads.

Marketing communications

If you subscribe to our newsletter, request information, or become a client, we may send you occasional emails about our services, new work and useful industry content. Every marketing email includes an unsubscribe link, and you can also unsubscribe at any time by emailing Simon@colourberry.com. We will act on your request promptly.

We do not sell, rent or trade your contact details to third parties for their own marketing purposes.

Who we share your information with

We do not sell your personal information. We disclose it only in the following circumstances:

  • Service providers and contractors who help us operate, including our web hosting provider, email and file storage providers, email marketing platform, accounting software provider, and freelance crew such as camera operators, editors, animators, voice artists and developers engaged on a specific project. These parties are only given the information they need and are required to keep it confidential.
  • Clients, where we have captured footage, photographs or other material on their behalf as part of a commissioned project.
  • Professional advisers such as our accountant or legal advisers where necessary.
  • Regulators, courts and law enforcement, where we are required or authorised by law to disclose information.
  • A purchaser or successor, if our business or part of it is sold or transferred, subject to equivalent privacy protections.

Overseas disclosure and international transfers

Colourberry is based in Australia, and your information will generally be stored and processed here. However, some of the platforms we rely on are operated by providers located overseas, or store data in overseas data centres. These are most commonly in the United States, the European Union, Singapore and the United Kingdom, and typically include cloud storage, email, analytics and email marketing services.

Under APP 8, we take reasonable steps to ensure overseas recipients handle your personal information in a manner consistent with the Australian Privacy Principles. Where personal data is transferred out of the UK or EEA, we rely on an adequacy decision where one applies, or on Standard Contractual Clauses or equivalent safeguards offered by the provider.

How we store and protect your information

We take reasonable technical and organisational steps to protect personal information from misuse, interference, loss, unauthorised access, modification and disclosure. These measures include password protected and access controlled systems, encrypted storage and transfer where available, multi-factor authentication on key accounts, regular backups of project files, up to date software and security patching, and limiting access to project material to the people who need it.

No method of transmission over the internet or method of electronic storage is completely secure. While we work hard to protect your information, we cannot guarantee absolute security. If we become aware of a data breach that is likely to result in serious harm, we will notify affected individuals and the Office of the Australian Information Commissioner in accordance with the Notifiable Data Breaches scheme, and, where the GDPR applies, the relevant supervisory authority within the required timeframe.

How long we keep your information

We keep personal information only for as long as we need it for the purposes described in this policy, or for as long as the law requires. In general terms:

  • General enquiries that do not become projects are kept for up to two years, then deleted.
  • Client project records, contracts and correspondence are kept for the life of the relationship and for at least seven years afterwards, to meet Australian tax and record keeping obligations.
  • Raw footage, project files and production assets are archived for an agreed period after delivery so that revisions and re-edits remain possible, then deleted or returned to the client on request.
  • Newsletter subscriber details are kept until you unsubscribe, after which we retain a minimal suppression record so we do not contact you again in error.

Your rights and choices

If you are in Australia

Under the Australian Privacy Principles you have the right to ask for access to the personal information we hold about you, and to ask us to correct it if it is inaccurate, out of date, incomplete, irrelevant or misleading. You also have the right to opt out of direct marketing at any time, and to deal with us anonymously or under a pseudonym where it is lawful and practicable.

To make a request, email Simon@colourberry.com. We will respond within a reasonable period, usually within 30 days. We may need to verify your identity first. There is normally no charge, although we may pass on a reasonable cost for retrieving extensive archived material. If we refuse a request, we will explain why in writing.

If you are in the UK or the EEA

Where the UK GDPR or EU GDPR applies, you additionally have the right to request erasure of your data, to request restriction of processing, to object to processing carried out on the basis of legitimate interests, to request a portable copy of data you provided to us, and to withdraw consent at any time. You also have the right not to be subject to decisions based solely on automated processing that produce legal or similarly significant effects. We do not carry out such automated decision making.

Requests can be sent to Simon@colourberry.com and will be answered within one month, which may be extended by a further two months for complex requests.

Children and young people

Our website and services are directed at businesses and are not intended for children. We do not knowingly collect personal information from anyone under 16 through this website. Where a production involves filming children, for example in an education or community setting, we require written consent from a parent or guardian, arranged through the commissioning client, before any recording takes place. If you believe we hold information about a child that should not have been collected, please contact us and we will delete it.

Links to other websites

Our website and blog may link to third party sites, client projects, social media profiles and video platforms. We are not responsible for the content or privacy practices of those sites. We encourage you to read the privacy policy of any website you visit through a link from ours.

Changes to this policy

We may update this Privacy Policy from time to time to reflect changes in our practices, the services we use, or the law. The current version will always be published on this page with the date it was last updated at the top. Where the changes are significant, we will take reasonable steps to bring them to your attention. We recommend reviewing this page periodically.
